Bu nedenle \u201cnas\u0131l bir anayasa\u201d sorusu, \u00f6nceki ve mevcut anayasal mimarinin \u00fcretti\u011fi sonu\u00e7lar dikkate al\u0131narak ele al\u0131nmak zorundad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:24px\">Kuvvetler Ayr\u0131l\u0131\u011f\u0131ndan \u015eahsi Y\u00f6netime: Yedi Y\u0131ll\u0131k D\u00f6n\u00fc\u015f\u00fcm<\/h2>\n\n\n\n<p style=\"font-size:18px\">Yedi y\u0131l\u0131 a\u015fan Cumhurba\u015fkanl\u0131\u011f\u0131 H\u00fck\u00fbmet Sistemi, T\u00fcrkiye\u2019de kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesinin uygulamada ortadan kalkt\u0131\u011f\u0131, kurumsal devlet yap\u0131s\u0131n\u0131n zay\u0131flad\u0131\u011f\u0131 ve karar alma s\u00fcre\u00e7lerinin ki\u015fiselle\u015fti\u011fi bir y\u00f6netim d\u00fczenine d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. Cumhurba\u015fkan\u0131na yasama, y\u00fcr\u00fctme ve yarg\u0131 \u00fczerinde ola\u011fan\u00fcst\u00fc geni\u015f yetkiler sistem i\u00e7indeki denge ve denetimi ortadan kald\u0131rm\u0131\u015f, kamu y\u00f6netiminin i\u015fleyi\u015fini k\u0131r\u0131lgan h\u00e2le getirmi\u015ftir.<\/p>\n\n\n\n<p style=\"font-size:18px\">Anayasa ve kanunlarda h\u00e2len mevcut olan denetim kurumlar\u0131 ve yollar\u0131 ise pratikte kar\u015f\u0131l\u0131k bulmamaktad\u0131r. Sorunlar\u0131 tespit etmek, bunlar\u0131 raporlamak, idari ve adli mekanizmalarla denetim ve yarg\u0131 konusu yapmak imk\u00e2ns\u0131z hale gelmi\u015ftir. Hasbelkader ortaya \u00e7\u0131kan rapor ve kararlar (Say\u0131\u015ftay, Yarg\u0131tay, AYM, A\u0130HM), y\u00fcr\u00fctmenin tercihleriyle \u00f6rt\u00fc\u015fmedi\u011finde uygulanmamakta ya da etkisizle\u015ftirilmektedir. Ba\u011f\u0131ms\u0131z olmas\u0131 gereken denetim organlar\u0131n\u0131n, \u00fcst kurullar\u0131n ve yarg\u0131 mercilerinin \u00fczerindeki y\u00fcr\u00fctme bask\u0131s\u0131, kurumsal \u00f6zerkli\u011fi ortadan kald\u0131rm\u0131\u015f, bu durum sistem i\u00e7i denge-denetleme yap\u0131s\u0131n\u0131 derin bi\u00e7imde zedelemi\u015ftir.<\/p>\n\n\n\n<p style=\"font-size:18px\">B\u00fcrokrasinin i\u015fleyi\u015fi de benzer bir t\u0131kanmayla kar\u015f\u0131 kar\u015f\u0131yad\u0131r. \u015eube m\u00fcd\u00fcrl\u00fc\u011f\u00fc d\u00fczeyinde \u00e7\u00f6z\u00fclebilecek standart i\u015flemler dahi Cumhurba\u015fkan\u0131 onay\u0131na kadar uzanmaktad\u0131r. Yetki ve sorumluluk da\u011f\u0131l\u0131m\u0131n\u0131n sa\u011fl\u0131kl\u0131 \u015fekilde i\u015flememesi, basit i\u015flerde bile gecikmelere yol a\u00e7makta; devlet mekanizmas\u0131 do\u011fal ritmini kaybetmektedir.<\/p>\n\n\n\n<p style=\"font-size:18px\">Sistemin ba\u015flang\u0131c\u0131nda ileri s\u00fcr\u00fclen \u201cistikrar\u201d ve \u201cetkin y\u00f6netim\u201d iddialar\u0131 ise sahada kar\u015f\u0131l\u0131k bulmam\u0131\u015ft\u0131r. Y\u00f6netimde istikrar, hukuka ba\u011fl\u0131l\u0131k, \u00f6ng\u00f6r\u00fclebilirlik ve \u015feffafl\u0131k gibi temel unsurlarla m\u00fcmk\u00fcnd\u00fcr; oysa y\u00fcr\u00fctme yetkisinin tek bir makamda birikmesi, bakanl\u0131klar\u0131n ve b\u00fcrokrasinin yetkisizle\u015fmesi, karar s\u00fcre\u00e7lerinin ihtiya\u00e7 ve etki analizinin yap\u0131lmamas\u0131 y\u00fcksek hata maliyeti \u00fcreten k\u0131r\u0131lgan bir yap\u0131 ortaya koymu\u015ftur. Hesap verebilirli\u011fin gerilemesi, liyakat mekanizmas\u0131n\u0131n a\u015f\u0131nmas\u0131 ve keyf\u00ee karar pratiklerinin yayg\u0131nla\u015fmas\u0131, etkinlik s\u00f6yleminin alt\u0131n\u0131 bo\u015faltm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\">Siyasetin yap\u0131s\u0131 da bu s\u00fcre\u00e7te k\u00f6kl\u00fc bir d\u00f6n\u00fc\u015f\u00fcm ya\u015fam\u0131\u015ft\u0131r. Parlamentonun kanun yapma ve y\u00fcr\u00fctmeyi denetleme fonksiyonlar\u0131 uygulamada \u00f6rne\u011fi olmayan sembolik bir \u00e7er\u00e7eveye s\u0131k\u0131\u015fm\u0131\u015f, Meclis\u2019in \u00e7al\u0131\u015fma temposu y\u00fcr\u00fctmenin ihtiya\u00e7 ve talepleriyle s\u0131n\u0131rl\u0131 bir \u00e7er\u00e7evede \u015fekillenmi\u015ftir. Cumhurba\u015fkan\u0131n\u0131n parti genel ba\u015fkan\u0131 s\u0131fat\u0131n\u0131 s\u00fcrd\u00fcrmesi, tarafs\u0131zl\u0131k ilkesini anlams\u0131zla\u015ft\u0131rmakla kalmam\u0131\u015f, siyasal kutupla\u015fmay\u0131 da derinle\u015ftirmi\u015ftir.<\/p>\n\n\n\n<p style=\"font-size:18px\">\u0130ktidar partisinin kendi i\u00e7 kurumsal mekanizmalar\u0131 da bu merkezile\u015fmeden etkilenmi\u015ftir. AK Parti Genel Merkezi ve TBMM Grubu, uzunca bir s\u00fcredir kritik meselelerde dahi isti\u015fari bir fonksiyon g\u00f6rememektedir. Yasa teklifleri dar bir \u00e7evrede haz\u0131rlanmakta, Meclis Grubu\u2019nun rol\u00fc yaln\u0131zca imza s\u00fcre\u00e7lerini tamamlamaya indirgenmektedir. Meclis g\u00fcndemi grup y\u00f6netimleri taraf\u0131ndan belirlenememekte, bir g\u00fcn g\u00f6r\u00fc\u015f\u00fclen bir teklif ertesi g\u00fcn ortadan kaybolmakta ve aylarca tekrar g\u00fcndeme gelmemektedir. G\u00fcndemine h\u00e2kim bir TBMM ve AK Parti Grup Y\u00f6netiminden bahsetmek imkans\u0131zd\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\">T\u00fcrkiye\u2019nin i\u00e7inde bulundu\u011fu ekonomik k\u0131r\u0131lganl\u0131k, hukuk g\u00fcvenli\u011finin zay\u0131flamas\u0131 ve kurumsal da\u011f\u0131n\u0131kl\u0131k, bu y\u00f6netim anlay\u0131\u015f\u0131n\u0131n \u00fcretti\u011fi yap\u0131sal sonu\u00e7lard\u0131r. Ba\u011f\u0131ms\u0131z kurumlar\u0131n siyasi ihtiya\u00e7lara g\u00f6re y\u00f6nlendirilmesi, liyakat yerine sadakatin esas al\u0131nmas\u0131, devletin nitelikli insan kayna\u011f\u0131n\u0131 erozyona u\u011fratm\u0131\u015f; kurumsal haf\u0131zay\u0131 ta\u015f\u0131yan kadrolar\u0131n tasfiyesi, pek \u00e7ok kamu kurumunda \u00f6ng\u00f6r\u00fcs\u00fcz kararlar ve y\u00fcksek maliyetli uygulamalar ortaya \u00e7\u0131karm\u0131\u015ft\u0131r. G\u00f6revde y\u00fckselme sisteminin kurumsal ilkelerden kopmas\u0131, kamu y\u00f6netiminde d\u00fczenli bir yap\u0131n\u0131n yerini rastlant\u0131sal ve g\u00fcn\u00fcbirlik tercihlere b\u0131rakmas\u0131na neden olmu\u015ftur.<\/p>\n\n\n\n<p style=\"font-size:18px\">Sistemin h\u0131zl\u0131 karar alma iddias\u0131 da denetim zafiyeti nedeniyle ger\u00e7ek\u00e7i bir avantaj olu\u015fturmam\u0131\u015ft\u0131r. Denetimsiz h\u0131z idari hatalar\u0131 b\u00fcy\u00fctm\u00fc\u015ft\u00fcr. Kamu kaynaklar\u0131n\u0131n plans\u0131z kullan\u0131m\u0131ndan, sonu\u00e7lar\u0131 \u00f6ng\u00f6r\u00fclmemi\u015f idari tercihlere kadar uzanan geni\u015f bir alanda bu durumun etkileri g\u00f6r\u00fclmektedir. Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n zay\u0131flamas\u0131, Merkez Bankas\u0131, T\u00dc\u0130K ve Say\u0131\u015ftay gibi kurumlar\u0131n \u00f6zerkli\u011fini kaybetmesi, ekonomik istikrar ve hukuk devleti anlay\u0131\u015f\u0131n\u0131 daha da zay\u0131flatmaktad\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\">Demokratik temsil ve hesap verebilirlik anlay\u0131\u015f\u0131 da bu d\u00f6nemde b\u00fcy\u00fck \u00f6l\u00e7\u00fcde gerilemi\u015ftir. Y\u00fcr\u00fctmenin Meclis kar\u015f\u0131s\u0131nda sorumluluk ta\u015f\u0131mamas\u0131, denetim organlar\u0131n\u0131n etkisizle\u015fmesi ve siyasal alan\u0131n daralmas\u0131, demokratik i\u015fleyi\u015fi zay\u0131flatan ba\u015fl\u0131ca etkenlerdir. Oysa demokrasi yaln\u0131zca se\u00e7im sand\u0131\u011f\u0131ndan ibaret de\u011fildir; y\u00f6netenlerin \u015feffaf, s\u00fcreklilik arz eden ve denetlenebilir bir y\u00f6netim anlay\u0131\u015f\u0131n\u0131 s\u00fcrd\u00fcrmesi gerekir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:24px\">T\u00fcrkiye\u2019yi G\u00fc\u00e7lendirilmi\u015f Parlamenter Sistem Kurtar\u0131r<\/h2>\n\n\n\n<p style=\"font-size:18px\">Mevcut sistemin k\u00fc\u00e7\u00fck onar\u0131mlarla d\u00fczeltilemeyece\u011fi izahtan varestedir. Bu nedenle T\u00fcrkiye\u2019nin yeniden hukuk devleti \u00e7izgisine d\u00f6nmesi i\u00e7in G\u00fc\u00e7lendirilmi\u015f Parlamenter Sisteme ge\u00e7i\u015fi zorunludur. Tarafs\u0131z bir Cumhurba\u015fkanl\u0131\u011f\u0131 makam\u0131, etkili sistem i\u00e7i denge ve denetleme mekanizmalar\u0131, yap\u0131c\u0131 g\u00fcvensizlik oyuna dayal\u0131 istikrarl\u0131 bir y\u00fcr\u00fctme yap\u0131s\u0131, Meclis\u2019in denetim rol\u00fc ve devredilemez b\u00fct\u00e7e hakk\u0131n\u0131n g\u00fc\u00e7lendirilmesi, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n ger\u00e7ek anlamda g\u00fcvence alt\u0131na al\u0131nmas\u0131 ve temsilde adaleti esas alan bir se\u00e7im mimarisi bu sistemin temel s\u00fctunlar\u0131n\u0131 olu\u015fturacakt\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\">Son d\u00f6nemde yeniden g\u00fcndeme gelen Anayasa de\u011fi\u015fikli\u011fi tart\u0131\u015fmalar\u0131 bu a\u00e7\u0131dan \u00f6nemlidir. Yap\u0131lacak d\u00fczenlemelerin kuvvetler ayr\u0131l\u0131\u011f\u0131n\u0131 g\u00fc\u00e7lendirmesi, Meclis-y\u00fcr\u00fctme ili\u015fkisi ve kurumlararas\u0131 demokratik dengeyi yeniden kurmas\u0131 y\u00f6n\u00fcnde at\u0131lacak her ad\u0131m de\u011ferlidir. Meclis aritmeti\u011fi parlamenter modele d\u00f6n\u00fc\u015f\u00fc k\u0131sa vadede m\u00fcmk\u00fcn k\u0131lmasa dahi g\u00fc\u00e7ler aras\u0131ndaki dengesizli\u011fi azaltacak her giri\u015fim \u00fclkenin yarar\u0131na olacakt\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\">T\u00fcrkiye\u2019nin gelece\u011fi, denetimsiz ve tek merkezli y\u00f6netim anlay\u0131\u015f\u0131n\u0131 s\u00fcrd\u00fcrmekte de\u011fil; kurumlar\u0131n\u0131 g\u00fc\u00e7lendiren, hukuk g\u00fcvencesini peki\u015ftiren ve demokratik dengeyi yeniden tesis eden, birey a\u00e7\u0131s\u0131ndan \u00f6zg\u00fcrl\u00fck\u00e7\u00fc ve hukuk g\u00fcvenli\u011finin sa\u011fland\u0131\u011f\u0131 bir sisteme y\u00f6nelmekte yatmaktad\u0131r. G\u00fc\u00e7lendirilmi\u015f parlamenter sistem, bu hedefe ula\u015fman\u0131n en sa\u011flam yolunu olu\u015fturmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:24px\">Nas\u0131l Bir Anayasa?<\/h2>\n\n\n\n<p style=\"font-size:18px\">Demokrasi ve At\u0131l\u0131m Partisi olarak, T\u00fcrkiye\u2019nin siyasal sorunlar\u0131n\u0131n temelinde anayasal d\u00fczen tercihlerine ili\u015fkin hata ve eksikliklerin yatt\u0131\u011f\u0131na inanmaktay\u0131z.<\/p>\n\n\n\n<p style=\"font-size:18px\">T\u00fcrkiye\u2019de anayasalar, toplumun \u00f6zg\u00fcrl\u00fck ve demokrasi taleplerini yans\u0131tmaktan ve toplumsal bar\u0131\u015f\u0131 tesis etmekten uzak kalm\u0131\u015ft\u0131r. Bireye ve devlete y\u00fcklenen anlam, toplum tasavvuru, kimlik ve inan\u00e7 tercihleri, devleti hakem olmaktan \u00e7\u0131kar\u0131p bir taraf haline getirmi\u015ftir. Devlet; toplum ve birey taraf\u0131ndan tan\u0131mlanan de\u011fil; toplumu ve bireyi tan\u0131mlayan, onun kimli\u011fine m\u00fcdahale eden, ideolojik tarafs\u0131zl\u0131\u011f\u0131 bulunmayan bir yap\u0131 olagelmi\u015ftir.<\/p>\n\n\n\n<p style=\"font-size:18px\">Demokrasi ve At\u0131l\u0131m Partisi olarak anayasay\u0131, milletimizin \u201cbir arada ya\u015fama ilkeleri\u201d olarak g\u00f6rmekteyiz. Bu \u00e7er\u00e7evede, T\u00fcrkiye\u2019nin bug\u00fcne kadarki anayasa deneyimlerinden de yararlanarak, toplumsal talepleri merkeze alan, t\u00fcm farkl\u0131l\u0131klar\u0131 de\u011ferli g\u00f6ren toplumsal s\u00f6zle\u015fme niteli\u011findeki bir anayasay\u0131 hayata ge\u00e7irmeyi ama\u00e7l\u0131yoruz. Yeni bir anayasa yap\u0131m\u0131n\u0131n ve anayasa de\u011fi\u015fikliklerinin ola\u011fan d\u00f6nemlerde, kat\u0131l\u0131mc\u0131 ve m\u00fczakereci bir y\u00f6ntemle, geni\u015f bir mutabakatla olmas\u0131 gerekti\u011fine inan\u0131yoruz.<\/p>\n\n\n\n<p style=\"font-size:18px\">\u0130nsan onurunun dokunulmazl\u0131\u011f\u0131n\u0131, temel hak ve \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131nd\u0131\u011f\u0131 kuvvetler ayr\u0131l\u0131\u011f\u0131na dayanan demokratik bir d\u00fczeni, ya\u015fam\u0131n temeli olan do\u011fan\u0131n ve \u00e7evrenin korunmas\u0131n\u0131, e\u015fitli\u011fi ve adaleti, laiklik ilkesini ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc, devletin ideolojik tarafs\u0131zl\u0131\u011f\u0131n\u0131, yerinden y\u00f6netimi ve yerel y\u00f6netimler ile sivil toplumun g\u00fc\u00e7lendirilmesini anayasal d\u00fczenin temel ilkeleri olarak kabul ediyoruz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Toplumun anayasal d\u00fczeni benimsemesi ve sahiplenmesi ancak demokratik kat\u0131l\u0131mla m\u00fcmk\u00fcnd\u00fcr. Bu \u00e7er\u00e7evede; devletin t\u00fcm kurumsal yap\u0131lanmas\u0131n\u0131, hi\u00e7bir istisna tan\u0131maks\u0131z\u0131n t\u00fcm toplumsal farkl\u0131l\u0131klar\u0131n ayr\u0131ms\u0131z ve \u00f6n ko\u015fulsuz kat\u0131l\u0131m\u0131na ve temsiline dayand\u0131raca\u011f\u0131z.<\/p>\n\n\n\n<p style=\"font-size:18px\">Kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesi, \u00f6zg\u00fcrl\u00fckleri g\u00fcvence alt\u0131na alabilmenin bir gere\u011fi olarak yasama, y\u00fcr\u00fctme ve yarg\u0131 erklerinin birbirlerinden ayr\u0131lmas\u0131 gerekti\u011fini ifade eder. B\u00fct\u00fcn g\u00fc\u00e7lerin tek bir elde toplanmas\u0131 halinde y\u00f6netimin denetlenemeyece\u011fi, keyfili\u011fe ka\u00e7aca\u011f\u0131 ve bu sebeple de \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131namayaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesinin amac\u0131, iktidar\u0131 yozla\u015fmadan al\u0131koymak, keyfili\u011fe kaymas\u0131n\u0131 \u00f6nlemek, frenlemek ve s\u0131n\u0131rlamak suretiyle \u00f6zg\u00fcrl\u00fckleri korumak ve g\u00fcvence alt\u0131na almakt\u0131r. Bu nedenle, Cumhurba\u015fkan\u0131n\u0131n a\u011f\u0131rl\u0131kl\u0131 olarak temsili yetkilere sahip oldu\u011fu, tarafs\u0131zl\u0131\u011f\u0131yla b\u00fct\u00fcnle\u015ftirici ve g\u00fcven verici i\u015flevinin bulundu\u011fu, g\u00fc\u00e7l\u00fc bir parlamenter sisteme ge\u00e7ilmesi gerekti\u011fine inan\u0131yoruz. T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ni, millet iradesinin en y\u00fcksek oranda temsil edildi\u011fi, siyasal sistemin merkezinde yer alan ve y\u00fcr\u00fctmeyi etkin \u015fekilde denetleyen bir organ haline getirece\u011fiz. TBMM\u2019nin yasama ve denetim faaliyetlerini uzla\u015fmac\u0131 ve \u00e7o\u011fulcu y\u00f6ntemlerle ger\u00e7ekle\u015ftirmesi gerekti\u011fine inan\u0131yoruz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Meclis komisyonlar\u0131n\u0131n teknik kapasitesini g\u00fc\u00e7lendirerek yasama ve denetim faaliyetlerinin niteli\u011fini art\u0131raca\u011f\u0131z.<\/p>\n\n\n\n<p style=\"font-size:18px\">TBMM\u2019nin, y\u00fcr\u00fctmenin sadece siyasi kanad\u0131n\u0131 de\u011fil; ba\u015fta g\u00fcvenlik, istihbarat ve d\u0131\u015f politika alanlar\u0131 dahil olmak \u00fczere kurum ve kurulu\u015flar\u0131 da denetlemesini sa\u011flayaca\u011f\u0131z. \u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz parlamenter sistemin bir gere\u011fi olarak, Kanun H\u00fckm\u00fcnde Kararname gibi TBMM\u2019nin yasama yetkisinin devri anlam\u0131na gelen uygulamalara son verece\u011fiz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Teknolojinin sundu\u011fu imk\u00e2nlardan da en \u00fcst d\u00fczeyde yararlanarak vatanda\u015flar\u0131m\u0131z\u0131n ve sivil toplum kurulu\u015flar\u0131n\u0131n yasa yapma s\u00fcrecine daha etkin bi\u00e7imde kat\u0131l\u0131m\u0131n\u0131 sa\u011flayaca\u011f\u0131z. Ola\u011fan\u00fcst\u00fc Hal Kararnameleriyle temel hak ve \u00f6zg\u00fcrl\u00fcklere getirilecek s\u0131n\u0131rlamalar\u0131n, hakk\u0131n \u00f6z\u00fcne dokunamayaca\u011f\u0131 esas\u0131n\u0131 benimseyece\u011fiz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Bu kararnamelerin yarg\u0131sal denetime a\u00e7\u0131lmas\u0131n\u0131 ve Anayasa Mahkemesi taraf\u0131ndan temel haklar bak\u0131m\u0131ndan re\u2019sen incelenmesini sa\u011flayaca\u011f\u0131z. OHAL\u2019in sona ermesi halinde, kararnamelerin t\u00fcm sonu\u00e7lar\u0131yla birlikte ortadan kald\u0131r\u0131lmas\u0131n\u0131 temin edece\u011fiz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesinin vazge\u00e7ilmez unsuru olan yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131 tam olarak sa\u011flamak amac\u0131yla, yarg\u0131 sistemini yeniden tanzim edece\u011fiz. Bu alanda Avrupa demokratik standartlar\u0131n\u0131 yans\u0131tan Venedik Komisyonu \u00e7al\u0131\u015fmalar\u0131ndan yararlanaca\u011f\u0131z.<\/p>\n\n\n\n<p style=\"font-size:18px\">Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131 bak\u0131m\u0131ndan son derece \u00f6nemli olan y\u00fcksek yarg\u0131 kurullar\u0131n\u0131, yarg\u0131n\u0131n demokratik me\u015fruiyeti ve \u00e7o\u011fulculu\u011fu ilkeleri \u00e7er\u00e7evesinde yeniden tanzim etmeyi hedefliyoruz. Y\u00fcksek yarg\u0131 kurullar\u0131 \u00fcyelerinin, tek ba\u015f\u0131na devlet ba\u015fkan\u0131, parlamentodaki bir siyasi parti \u00e7o\u011funlu\u011fu veya yarg\u0131da grupla\u015fmalara neden olacak y\u00f6ntemlerle belirlenmesinin do\u011fru olmad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcn\u00fcyoruz. Bu nedenle, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ve s\u0131n\u0131rl\u0131 iktidar ilkesi do\u011frultusunda y\u00fcksek yarg\u0131 kurullar\u0131nda tarafs\u0131zl\u0131\u011f\u0131n ve ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n ve \u00e7o\u011fulculu\u011fun sa\u011flanmas\u0131 amac\u0131yla, \u00fcye se\u00e7iminde kaynak \u00e7e\u015fitlili\u011fine \u00f6nem verilmesini, Meclis\u2019in etkinli\u011finin artt\u0131r\u0131lmas\u0131n\u0131 ve se\u00e7imlerin nitelikli \u00e7o\u011funlu\u011fa dayal\u0131 olarak yap\u0131lmas\u0131n\u0131 savunuyoruz.<\/p>\n\n\n\n<p style=\"font-size:18px\">Anayasa Mahkemesinin demokratik me\u015fruiyetini g\u00fc\u00e7lendirece\u011fiz. Mahkeme \u00fcyelerinin se\u00e7iminde TBMM taraf\u0131ndan se\u00e7ilecek \u00fcye say\u0131s\u0131n\u0131 artt\u0131racak ve se\u00e7imlerde nitelikli \u00e7o\u011funluk arayaca\u011f\u0131z. Bireysel ba\u015fvurular\u0131n daha k\u0131sa s\u00fcrede sonu\u00e7lanmas\u0131 i\u00e7in Mahkemenin kapasitesini artt\u0131racak tedbirleri alaca\u011f\u0131z. Anayasa Mahkemesi kararlar\u0131n\u0131n uygulanmamas\u0131 hukuk g\u00fcvenli\u011fi \u00fczerinde b\u00fcy\u00fck tahribat olu\u015fturmaktad\u0131r. Bu kararlar\u0131n Anayasa\u2019da \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u015fekilde derhal uygulanmas\u0131n\u0131 sa\u011flayacak ad\u0131mlar\u0131 ataca\u011f\u0131z.<\/p>\n\n\n\n<p style=\"font-size:18px\">T\u00fcrkiye\u2019nin temel ve kronik sorunlar\u0131, hukuku dolanan, yarg\u0131y\u0131 ara\u00e7salla\u015ft\u0131ran, kurumlar\u0131 zay\u0131flatan kuvvetler birli\u011fine dayal\u0131 y\u00f6netim bi\u00e7iminden kaynaklanmaktad\u0131r. Yeni Anayasan\u0131n, yaln\u0131zca y\u00fczeysel reformlarla s\u0131n\u0131rl\u0131 kalmay\u0131p; vatanda\u015f\u0131 merkeze alan, \u00f6zg\u00fcrl\u00fck\u00e7\u00fc, kat\u0131l\u0131mc\u0131, \u00e7o\u011fulcu, g\u00fc\u00e7l\u00fc denetim mekanizmalar\u0131na sahip, kuvvetler ayr\u0131l\u0131\u011f\u0131n\u0131 ve tam demokrasiyi yeniden tesis edecek G\u00fc\u00e7lendirilmi\u015f Parlamenter Sistem\u2019e ge\u00e7i\u015fi sa\u011flayacak bir demokratik anayasal s\u00f6zle\u015fme niteli\u011fi ta\u015f\u0131mas\u0131 gerekmektedir. Bu kapsamda;<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Din ve Vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fc g\u00fc\u00e7lendirilmeli:<\/u> <\/strong>Anayasa\u2019da din ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fc g\u00fc\u00e7lendirilmelidir. Aleviler, di\u011fer dini ve felsefi inan\u00e7 gruplar\u0131n\u0131n bireysel ve \u00f6rg\u00fctlenme haklar\u0131 kendi dini alanlar\u0131n\u0131n kamu nezdinde kabul g\u00f6rmesine ili\u015fkin bir yakla\u015f\u0131m esas al\u0131nmal\u0131d\u0131r. Hak temelli \u00f6rg\u00fctlenmelerin, demokratik toplumun gereklerine uygun bir \u015fekilde kurulabilmesi ve faaliyetlerini s\u00fcrd\u00fcrebilmeleri i\u00e7in \u00f6zg\u00fcrl\u00fck\u00e7\u00fc bir \u00e7er\u00e7eve hayata ge\u00e7irilmelidir.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Anayasaya \u00f6zg\u00fcrl\u00fck\u00e7\u00fc anlay\u0131\u015f kazand\u0131r\u0131lmal\u0131:<\/u> <\/strong>Anayasa, temel haklar\u0131 \u201c\u00f6dev\u201d olarak vurgulayan ve h\u00fcrriyetleri \u00f6dev kavram\u0131yla s\u0131n\u0131rlayan anlay\u0131\u015ftan ar\u0131nd\u0131r\u0131larak, \u00f6zg\u00fcrl\u00fck\u00e7\u00fc bir anlay\u0131\u015f kazand\u0131r\u0131lmal\u0131d\u0131r. Anayasadan otoriter anlay\u0131\u015f\u0131n izleri silinmeli, \u201ctemel hak ve \u00f6devler\u201d yerine \u201ctemel hak ve h\u00fcrriyetler\u201d d\u00fczenlenmelidir. Anadillere dair yasak\u00e7\u0131 yakla\u015f\u0131m yerine korumac\u0131 ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc bir yakla\u015f\u0131m benimsenmeli. Vatanda\u015fl\u0131k maddesi kapsay\u0131c\u0131 bir yakla\u015f\u0131mla yeniden d\u00fczenlenmelidir.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>\u201c\u0130nsan onuru\u201d Anayasan\u0131n temel esas\u0131 olmal\u0131:<\/u> <\/strong>Anayasan\u0131n temel haklar\u0131 d\u00fczenleyen ilk maddesine \u201c\u0130nsan onuru dokunulmazd\u0131r ve anayasal d\u00fczenin temelidir\u201d ifadesi eklenerek, Anayasan\u0131n insan onurunu esas alan bir bak\u0131\u015f a\u00e7\u0131s\u0131 kazanmas\u0131 sa\u011flanmal\u0131. Devletin temel i\u015flevinin insan onurunu korumak ve ona sayg\u0131 g\u00f6stermek oldu\u011fu vurgulanmal\u0131d\u0131r.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Teredd\u00fct halinde yorum, h\u00fcrriyet lehine yap\u0131lmal\u0131:<\/u><\/strong> Anayasa\u2019n\u0131n 13\u2019\u00fcnc\u00fc maddesine \u201cH\u00fcrriyet esas, s\u0131n\u0131rlama istisnad\u0131r. Teredd\u00fct halinde yorum h\u00fcrriyet lehine yap\u0131l\u0131r.\u201d h\u00fckm\u00fc eklenmeli. Mahkemenin b\u00f6l\u00fcm say\u0131s\u0131 2\u2019den 4\u2019e y\u00fckseltilerek bireysel ba\u015fvurular\u0131n incelenmesinde etkinlik artt\u0131r\u0131lmal\u0131.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Partili cumhurba\u015fkanl\u0131\u011f\u0131 d\u00f6nemi kapanmal\u0131:<\/u> <\/strong>Cumhurba\u015fkan\u0131n\u0131n halk taraf\u0131ndan se\u00e7imine devam edilecek ise; 7 y\u0131ll\u0131\u011f\u0131na halk taraf\u0131ndan se\u00e7ilmesi ile se\u00e7imle beraber partisiyle ili\u015fkisi sona ermeli. Kapatma davas\u0131n\u0131n a\u00e7\u0131labilmesi, TBMM\u2019nin \u00fc\u00e7te ikisinin oyuyla al\u0131nacak izne ba\u011flanmal\u0131. Milletvekillerinin meclis k\u00fcrs\u00fcs\u00fcnde kulland\u0131\u011f\u0131 ifadelerin parti kapatma davalar\u0131nda delil olamayaca\u011f\u0131 d\u00fczenlenmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Dokunulmazl\u0131\u011f\u0131n kald\u0131r\u0131lmas\u0131 zorla\u015ft\u0131r\u0131lmal\u0131:<\/u> <\/strong>Milletvekillerinin sadece a\u011f\u0131r ceza mahkemesinin g\u00f6revine giren su\u00e7\u00fcst\u00fc halinde dokunulmazl\u0131ktan faydalanamayaca\u011f\u0131 d\u00fczenlenmeli. Anayasan\u0131n 83\u2019\u00fcnc\u00fc maddesinde Anayasan\u0131n 14\u2019\u00fcnc\u00fc maddesine yap\u0131lan at\u0131f metinden \u00e7\u0131kar\u0131lmal\u0131 veyahut bu konunun \u00f6zel bir kanunla d\u00fczenlenece\u011fi belirtilmeli. Dokunulmazl\u0131\u011f\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in \u00fcye tam say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011fu ile karar al\u0131naca\u011f\u0131 h\u00fckm\u00fc getirilmeli. Milletvekili d\u00fc\u015fme karar\u0131nda bireysel ba\u015fvuru yoluna gidilmi\u015f ise karar\u0131n uygulanmas\u0131 i\u00e7in Anayasa Mahkemesinin karar\u0131 beklenmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>\u00c7ocuk ve Kad\u0131na kar\u015f\u0131 su\u00e7 se\u00e7ilme engeli olu\u015fturmal\u0131:<\/u> <\/strong>Affa u\u011fram\u0131\u015f olsalar bile cinsel sald\u0131r\u0131, \u00e7ocuklar\u0131n cinsel istismar\u0131, kad\u0131na y\u00f6nelik kasten yaralama ve edimi ifas\u0131n\u0131 fesat kar\u0131\u015ft\u0131rma su\u00e7lar\u0131ndan h\u00fck\u00fcm giymi\u015f olanlar\u0131n milletvekili se\u00e7ilme yeterlili\u011fine sahip olamayaca\u011f\u0131 a\u00e7\u0131k\u00e7a d\u00fczenlenmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Uluslararas\u0131 anla\u015fmalardan \u00e7ekilme karar\u0131 a\u00e7\u0131k\u00e7a TBMM\u2019nin uygun bulmas\u0131na ba\u011flanmal\u0131: <\/u><\/strong>T\u00fcrkiye\u2019nin taraf oldu\u011fu bir uluslararas\u0131 anla\u015fmadan \u00e7ekilebilmesinin ancak TBMM\u2019nin uygun bulmas\u0131 \u015fart\u0131 ger\u00e7ekle\u015febilmesi Anayasada a\u00e7\u0131k\u00e7a d\u00fczenlenmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Meclis Ara\u015ft\u0131rma Komisyonu\u2019nun davetine uymak zorunlu hale getirilmeli:<\/u> <\/strong>Meclisin denetim yetkisi g\u00fc\u00e7lendirilerek \u015feffaf ve hesap verebilir bir y\u00f6netim i\u00e7in h\u00fck\u00fcmete hesap sorulabilmesini sa\u011flayacak ara\u00e7lar art\u0131r\u0131l\u0131p etkili k\u0131l\u0131nmal\u0131. Muhalefete bir yasama y\u0131l\u0131nda en az yirmi g\u00fcn g\u00fcndemi belirleyerek genel g\u00f6r\u00fc\u015fme a\u00e7ma hakk\u0131 tan\u0131nanarak, Meclis Ara\u015ft\u0131rma Komisyonunun davetine uyma zorunlulu\u011fu d\u00fczenlenmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Milletin meclisi, b\u00fct\u00e7e yetkisine kavu\u015fmal\u0131:<\/u><\/strong> B\u00fct\u00e7e yetkisi Meclis\u2019e iade edilmeli. H\u00fck\u00fcmetlerin politikalar\u0131n\u0131 B\u00fct\u00e7e Kanununun s\u0131n\u0131rlar\u0131na uygun olarak y\u00fcr\u00fctmelerini sa\u011flamak amac\u0131yla kesin hesap Anayasada ayr\u0131 bir maddede d\u00fczenlenmeli, Kesin Hesap Komisyonu kurulmal\u0131 ve ba\u015fkan\u0131n\u0131n ana muhalefet partisinin milletvekili olmas\u0131 \u015fart\u0131 getirilmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Yeni h\u00fck\u00fcmet kurulmadan mevcut h\u00fck\u00fcmet d\u00fc\u015f\u00fcr\u00fclememeli:<\/u> <\/strong>H\u00fck\u00fcmet, ba\u015fbakan ve bakanlar hakk\u0131nda gensoru verme yetkisi tesis edilmeli. Bu yenilikle, Bakanlar Kurulu aleyhine verilen g\u00fcvensizlik \u00f6nergelerine yeni Ba\u015fbakan\u0131n isminin eklenmesi zorunlu k\u0131l\u0131nmal\u0131. B\u00f6ylece Meclis, istikrar\u0131n gere\u011fi olarak ancak yeni h\u00fck\u00fcmeti kurmakta birle\u015febilirse mevcut h\u00fck\u00fcmeti d\u00fc\u015f\u00fcrebilmeli.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>Siyasi Partiler Yasas\u0131, Se\u00e7im Yasas\u0131, Siyasi Etik Yasas\u0131:<\/u> <\/strong>Anayasa, Siyasi Partiler Kanunu ve Se\u00e7im Kanunu\u2019nun, vatanda\u015f ve se\u00e7men odakl\u0131, parti i\u00e7i demokrasiyi esas alan, kat\u0131l\u0131mc\u0131 ve \u00e7o\u011fulcu ilkeler do\u011frultusunda d\u00fczenlenmesini ba\u011flay\u0131c\u0131 k\u0131lmal\u0131. Temsilde adalet, e\u015fit rekabet ve \u015feffafl\u0131k siyasi hayat\u0131n kurucu ilkeleri olarak anayasal \u00e7er\u00e7evede a\u00e7\u0131k\u00e7a tan\u0131mlanmal\u0131. Kamu b\u00fcrokratlar\u0131 ve siyaset\u00e7ilerin mal edinimi, sair ki\u015fi ve kurulu\u015flarla ili\u015fkileri ve siyasetin finansman\u0131na ili\u015fkin esaslar\u0131 d\u00fczenleyecek bir Siyasi Etik Yasas\u0131 da ayn\u0131 ilkeler do\u011frultusunda haz\u0131rlanmal\u0131, mali \u015feffafl\u0131k ve hesap verebilirlik ayr\u0131lmaz unsurlar olarak d\u00fczenlenmeli. Anayasa, bu \u00fc\u00e7 kanunun temel esaslar\u0131n\u0131 a\u00e7\u0131k\u00e7a tan\u0131mlayarak normatif s\u0131n\u0131rlar\u0131n\u0131 belirlemeli, demokratik siyasi hayat\u0131n kurucu ilkelerini belirsizlikten ar\u0131nd\u0131rmal\u0131 ve yap\u0131land\u0131rmal\u0131.<\/p>\n\n\n\n<p style=\"font-size:18px\"><strong><u>OHAL KHK\u2019lar\u0131na son verilmeli:<\/u> <\/strong>OHAL KHK\u2019lar\u0131 kald\u0131r\u0131lmal\u0131.
