Anayasa 19 defa de\u011fi\u015fikli\u011fe u\u011fram\u0131\u015f, \u00e7ok say\u0131da yeni anayasa giri\u015fimi olmu\u015f, siyasi partiler, sivil toplum \u00f6rg\u00fctleri, \u00fcniversiteler ve daha bir\u00e7ok kurum anayasa tasar\u0131lar\u0131 ve raporlar\u0131 haz\u0131rlam\u0131\u015ft\u0131r. Ancak aradan ge\u00e7en 43 y\u0131la ra\u011fmen hala sivil bir anayasan\u0131n haz\u0131rlanamam\u0131\u015f olmas\u0131 siyaset kurumunun ay\u0131b\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>Demokratik bir cumhuriyette anayasa yapma hakk\u0131 Millete ait tekel bir hakt\u0131r. Aziz Milletimiz, Anayasa yapma hakk\u0131n\u0131 bug\u00fcne kadar hi\u00e7bir zaman kullanamam\u0131\u015ft\u0131r.<\/strong>&nbsp;1982 Anayasas\u0131 milli iradeyi gasp eden darbeciler taraf\u0131ndan haz\u0131rlanan, bu a\u00e7\u0131dan milletin \u00f6zg\u00fcr iradesinin \u00fcr\u00fcn\u00fc olmayan ve millete dayat\u0131lan bir anayasad\u0131r.&nbsp;Darbecilerin yapt\u0131\u011f\u0131, mimar\u0131 darbeciler olan bir Anayasa ile y\u00f6netilmek T\u00fcrkiye\u2019ye yak\u0131\u015fmamaktad\u0131r. Milletin \u2018anayasa yapma hakk\u0131n\u0131\u2019 kullanmas\u0131 i\u00e7in darbe \u00fcr\u00fcn\u00fc mevcut anayasan\u0131n kald\u0131r\u0131larak yeni bir anayasa yap\u0131lmas\u0131 zaruridir.<\/p>\n\n\n\n<p>Bug\u00fcne kadar \u00e7ok say\u0131da anayasa reformuna ve yeni anayasa giri\u015fimine \u00f6nc\u00fcl\u00fck eden Partimiz, \u00f6n\u00fcm\u00fczdeki d\u00f6nemde \u00dclkemizi, in\u015fa edeni \u2018Millet\u2019 olan bir toplum s\u00f6zle\u015fmesine kavu\u015fturmak i\u00e7in \u00e7al\u0131\u015fmalar\u0131n\u0131 y\u00fcr\u00fctmektedir.<\/p>\n\n\n\n<p>AK Parti olarak demokratik, sivil, \u00f6zg\u00fcrl\u00fck\u00e7\u00fc ve yeni Anayasa\u2019y\u0131 m\u00fcmk\u00fcn olan en geni\u015f mutabakatla ve demokratik y\u00f6ntemle, toplumun b\u00fct\u00fcn kesimlerinin i\u00e7erisinde kendini bulaca\u011f\u0131 \u015fekilde Aziz Milletimizle birlikte yapma azim ve kararl\u0131l\u0131\u011f\u0131 i\u00e7erisindeyiz.<\/p>\n\n\n\n<p>Kurtulu\u015f Sava\u015f\u0131\u2019ndan sonra bizim en k\u0131ymetli kazan\u0131m\u0131m\u0131z Cumhuriyet\u2019tir. \u015eimdi Cumhuriyetimizin ikinci y\u00fczy\u0131l\u0131na girdik ancak hala Millet taraf\u0131ndan yap\u0131lan bir Anayasam\u0131z yok. Bu nedenle her \u015feyiyle milli iradenin \u00fcr\u00fcn\u00fc yeni bir Anayasay\u0131 \u00fclkemize kazand\u0131rmak, T\u00fcrkiye Y\u00fczy\u0131l\u0131\u2019n\u0131 yeni ve sivil bir Anayasa ile ta\u00e7land\u0131rmak en \u00f6nemli hedeflerimiz aras\u0131nda yer almaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2018Sessiz Devrim\u2019lere \u0130mza Att\u0131k<\/strong><\/h2>\n\n\n\n<p>Bilindi\u011fi \u00fczere Partimiz kuruldu\u011fu ilk g\u00fcnden itibaren \u00fclkemizin kronikle\u015fen ve kangrene d\u00f6n\u00fc\u015fen sorunlar\u0131n\u0131 \u00e7\u00f6zmek i\u00e7in demokrasi, insan haklar\u0131 ve adalet alan\u0131nda \u00e7ok say\u0131da reforma imza atm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>\u201cSessiz devrim\u201d olarak adland\u0131r\u0131lan bu reformlar ile d\u00fc\u015f\u00fcnce ve bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6n\u00fcndeki engelleri kald\u0131rd\u0131k, her t\u00fcrl\u00fc ayr\u0131mc\u0131l\u0131\u011fa son vererek b\u00fct\u00fcn din mensuplar\u0131 i\u00e7in inan\u00e7 ve ibadet \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc teminat alt\u0131na ald\u0131k, i\u015fkence ile aktif olarak m\u00fccadele ederek bu t\u00fcr iddialar\u0131 \u00fclke g\u00fcndeminden tamamen \u00e7\u0131kard\u0131k, hak arama yollar\u0131n\u0131 \u00e7o\u011faltt\u0131k ve devleti vatanda\u015f\u0131n denetimine a\u00e7t\u0131k, yarg\u0131 \u00fczerindeki vesayetlere son vererek daha etkin ve adil bir yarg\u0131 sistemi tesis ettik, kad\u0131n ve \u00e7ocuk haklar\u0131n\u0131n etkin korunmas\u0131 i\u00e7in k\u00f6kl\u00fc mevzuat de\u011fi\u015fiklikleri yapt\u0131k ve \u00e7ok say\u0131da yeni uygulamay\u0131 sistemimize kazand\u0131rd\u0131k.<\/p>\n\n\n\n<p>Bu reformlar\u0131 belli bir sistematik ve takvim i\u00e7erisinde y\u00fcr\u00fctmek amac\u0131yla \u201cYarg\u0131 Reformu Strateji Belgeleri\u201d ve \u201c\u0130nsan Haklar\u0131 Eylem Planlar\u0131\u201d a\u00e7\u0131klad\u0131k ve y\u00fcr\u00fcrl\u00fc\u011f\u00fcn\u00fc sa\u011flad\u0131k. Bu belgeler do\u011frultusunda \u00e7ok say\u0131da d\u00fczenlemeyi hayata ge\u00e7irdik ve ge\u00e7irmeye de devam ediyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Anayasa De\u011fi\u015fiklikleriyle Demokrasimizi G\u00fc\u00e7lendirdik<\/strong><\/h2>\n\n\n\n<p>Yasal ve idari d\u00fczenlemelerle hayata ge\u00e7irilen b\u00fct\u00fcn bu reformlar\u0131n yan\u0131 s\u0131ra kal\u0131c\u0131 \u00e7\u00f6z\u00fcmler \u00fcretmek ad\u0131na \u00e7ok say\u0131da anayasa de\u011fi\u015fikli\u011fi yapt\u0131k ve yeni anayasa aray\u0131\u015f\u0131ndan hi\u00e7bir zaman vazge\u00e7medik.<\/p>\n\n\n\n<p>23 y\u0131ll\u0131k iktidar\u0131m\u0131z boyunca demokrasimizi g\u00fc\u00e7lendirmek, hak ve \u00f6zg\u00fcrl\u00fckleri daha g\u00fcvenceli hale getirmek ve adaleti tesis etmek ad\u0131na anayasa reformlar\u0131n\u0131 hayata ge\u00e7irdik. Bunlardan baz\u0131lar\u0131n\u0131 s\u0131ralayacak olursak, 2002 y\u0131l\u0131nda yap\u0131lan de\u011fi\u015fiklik ile milletvekili se\u00e7ilmeye engel olu\u015fturan d\u00fc\u015f\u00fcnce su\u00e7lar\u0131n\u0131 Anayasadan \u00e7\u0131kard\u0131k.<\/p>\n\n\n\n<p>2004 y\u0131l\u0131nda temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin anla\u015fmalarla kanunlar\u0131n ayn\u0131 konuda farkl\u0131 h\u00fck\u00fcmler i\u00e7ermesi halinde, milletleraras\u0131 antla\u015fma h\u00fck\u00fcmlerinin esas al\u0131nmas\u0131n\u0131 \u00f6ng\u00f6rd\u00fck. Devlete kad\u0131n ve erkek aras\u0131nda e\u015fitli\u011fi sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirdik. Bas\u0131mevi ve eklentileri ile bas\u0131n ara\u00e7lar\u0131n\u0131n, hi\u00e7bir \u015fekilde su\u00e7 aleti oldu\u011fu gerek\u00e7esiyle zapt ve m\u00fcsadere edilemeyece\u011fini, i\u015fletilmekten al\u0131konulamayaca\u011f\u0131n\u0131 pozitif hukukumuza kazand\u0131rd\u0131k.<\/p>\n\n\n\n<p>2007 y\u0131l\u0131nda yap\u0131lan Anayasa de\u011fi\u015fikli\u011fi ile Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imlerini vesayet\u00e7i unsurlardan korumak amac\u0131yla Cumhurba\u015fkan\u0131n\u0131n halk taraf\u0131ndan se\u00e7ilmesine ili\u015fkin \u00f6nemli bir d\u00fczenlemeyi ger\u00e7ekle\u015ftirdik.<\/p>\n\n\n\n<p>2010 y\u0131l\u0131nda Anayasa Mahkemesine bireysel ba\u015fvuru yolunu getirdik, Kamu Denet\u00e7ili\u011fi Kurumu\u2019nu kurduk. \u00c7ocuk haklar\u0131n\u0131 ilk defa anayasal koruma alt\u0131na ald\u0131k ve sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc geli\u015ftirerek kamu g\u00f6revlilerine toplu s\u00f6zle\u015fme yapma hakk\u0131 getirdik. 12 Eyl\u00fcl askeri darbesini ger\u00e7ekle\u015ftirenleri koruyan Anayasan\u0131n ge\u00e7ici 15. maddesini y\u00fcr\u00fcrl\u00fckten kald\u0131rd\u0131k ve yarg\u0131lanmalar\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7t\u0131k. Kamu y\u00f6netiminde saydaml\u0131\u011f\u0131 esas alarak vatanda\u015flar\u0131m\u0131z\u0131n bilgi edinme hakk\u0131n\u0131 anayasal teminata kavu\u015fturduk. \u00dclkemizin hukuk devleti vasf\u0131n\u0131 g\u00fc\u00e7lendiren ad\u0131mlar att\u0131k.&nbsp;<\/p>\n\n\n\n<p>2017 y\u0131l\u0131nda Cumhurba\u015fkanl\u0131\u011f\u0131 H\u00fck\u00fcmet Sistemine ge\u00e7erek devletin daha h\u0131zl\u0131 ve etkin i\u015fleyece\u011fi, kuvvetler ayr\u0131l\u0131\u011f\u0131n\u0131 g\u00fc\u00e7lendiren ve b\u00fcrokratik vesayeti gerileten bir siyasal sistem tesis ettik.<\/p>\n\n\n\n<p>Hat\u0131rlanaca\u011f\u0131 \u00fczere 2008 y\u0131l\u0131nda TBMM\u2019de 411 milletvekili taraf\u0131ndan kabul edilen ve y\u00fcksek\u00f6\u011fretim \u00f6\u011frencileri i\u00e7in ba\u015f\u00f6rt\u00fcs\u00fcn\u00fc serbest b\u0131rakmay\u0131 ama\u00e7layan Anayasa de\u011fi\u015fikli\u011fi, Anayasa de\u011fi\u015fikliklerinin sadece \u015fekil bak\u0131m\u0131ndan incelenebilece\u011fi, esas a\u00e7\u0131s\u0131ndan Anayasa Mahkemesi denetimi d\u0131\u015f\u0131nda olmas\u0131na kar\u015f\u0131n, Anayasaya a\u00e7\u0131k\u00e7a ayk\u0131r\u0131 bir \u015fekilde esastan incelemeye tabi tutularak Anayasa Mahkemesi taraf\u0131ndan iptal edilmi\u015fti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Milletimizi Ku\u015fat\u0131c\u0131 Bir Anayasa \u0130le Bulu\u015fturaca\u011f\u0131z<\/strong><\/h2>\n\n\n\n<p>AK Parti olarak sadece anayasa de\u011fi\u015fiklikleri ile yetinmedik. T\u00fcrkiye\u2019nin darbe mahsul\u00fc 12 Eyl\u00fcl anayasas\u0131ndan kurtulmas\u0131 i\u00e7in yeni anayasa aray\u0131\u015flar\u0131n\u0131 hep destekledik ve \u00f6nc\u00fcl\u00fck ettik.<\/p>\n\n\n\n<p>T\u00fcrkiye\u2019ye ve T\u00fcrk demokrasisine yak\u0131\u015fmayan darbe mahsul\u00fc anayasaya kar\u015f\u0131l\u0131k T\u00fcrk milletinin ve siyaset kurumunun insan onuruna dayanan, tamamen \u00f6zg\u00fcrl\u00fck\u00e7\u00fc, demokratik ve sivil bir anayasa haz\u0131rlayacak iradeye ve birikime sahip oldu\u011funa her zaman inand\u0131k.<\/p>\n\n\n\n<p>AK Parti ve Cumhur \u0130ttifak\u0131 olarak T\u00fcrkiye\u2019nin ekonomide, demokraside, hak ve \u00f6zg\u00fcrl\u00fckler alan\u0131nda hedefine ula\u015fabilmesi i\u00e7in milletimizi yeni, sivil ve ku\u015fat\u0131c\u0131 bir Anayasa ile bulu\u015fturma kararl\u0131l\u0131\u011f\u0131m\u0131z\u0131 s\u0131k s\u0131k dile getiriyoruz. Bu konudaki irademiz de, duru\u015fumuz da nettir.<\/p>\n\n\n\n<p>2007 y\u0131l\u0131nda bir grup akademisyenden bir anayasa tasla\u011f\u0131 haz\u0131rlamas\u0131n\u0131 isteyerek yeni anayasa s\u00fcrecini ba\u015flatmak istemi\u015ftik. Ancak bu giri\u015fim Partimiz hakk\u0131nda a\u00e7\u0131lan kapatma davas\u0131 sebebiyle hayata ge\u00e7irilememi\u015fti.<\/p>\n\n\n\n<p>En ciddi giri\u015fim olan ve 2011 se\u00e7imlerinden sonra kurulan Anayasa Uzla\u015fma Komisyonu ise AK Parti\u2019nin t\u00fcm yap\u0131c\u0131 ve kolayla\u015ft\u0131r\u0131c\u0131 \u00e7abalar\u0131na ra\u011fmen yeni bir anayasa haz\u0131rlayamadan da\u011f\u0131lm\u0131\u015ft\u0131. AK Parti olarak bu Komisyonun \u00fczerinde uzla\u015ft\u0131\u011f\u0131 temel haklara ili\u015fkin 59 maddeyi sahiplenmi\u015f ve bunlar\u0131n yasala\u015fmas\u0131 i\u00e7in defalarca \u00e7a\u011fr\u0131 yapm\u0131\u015ft\u0131k.<\/p>\n\n\n\n<p>Bug\u00fcne kadar anayasa \u00e7abalar\u0131 b\u00fcrokratik vesayetin m\u00fcdahaleleri veya uzla\u015fma ortam\u0131n\u0131n tesis edilememesi nedeniyle daima akamete u\u011fram\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Milletimizi Tarihin \u00d6znesi Yapacak Bir \u2018Toplum S\u00f6zle\u015fmesi\u2019 Yapma Kararl\u0131l\u0131\u011f\u0131nday\u0131z<\/strong><\/h2>\n\n\n\n<p>K\u00fcresel ve b\u00f6lgesel de\u011fi\u015fimlerin h\u0131zland\u0131\u011f\u0131, tehditlerin, f\u0131rsatlar\u0131n ve risklerin her alanda kendini g\u00f6sterdi\u011fi bir d\u00f6nemde, T\u00fcrkiye\u2019mizi ve Milletimizi tarihin \u00f6znesi yapacak at\u0131l\u0131mlar i\u00e7in yeni bir \u201ctoplum s\u00f6zle\u015fmesi\u201d yapmaya kararl\u0131y\u0131z.<\/p>\n\n\n\n<p>Yap\u0131lan Anayasa de\u011fi\u015fikliklerine ra\u011fmen 1982 Anayasas\u0131\u2019nda 12 Eyl\u00fcl rejiminin izlerinin silinememi\u015f olmas\u0131 \u00fcz\u00fcnt\u00fc vericidir. Bu izleri silmeye y\u00f6nelik \u00e7ok say\u0131da de\u011fi\u015fiklik yap\u0131lm\u0131\u015f olsa da \u00f6zg\u00fcrl\u00fckler konusunda anayasan\u0131n geneline h\u00e2kim olan s\u0131n\u0131rland\u0131r\u0131c\u0131 ve istisnas\u0131 bol yakla\u015f\u0131m halen giderilebilmi\u015f de\u011fildir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Mevcut Anayasa <\/strong><strong>Sistematik B\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc Kaybetmi\u015f<\/strong><strong>tir<\/strong><\/h2>\n\n\n\n<p>1982 Anayasas\u0131nda bug\u00fcne kadar 19 defa de\u011fi\u015fiklik yap\u0131lm\u0131\u015f, bu de\u011fi\u015fikliklerin 12 tanesi AK Parti d\u00f6neminde ger\u00e7ekle\u015ftirilmi\u015ftir. Bu de\u011fi\u015fiklikler genel anlamda demokratikle\u015fme, hukuk devleti ve \u00f6zg\u00fcrl\u00fckleri geni\u015fletme yolunda olsa da Anayasa\u2019daki 12 Eyl\u00fcl rejiminin izlerini tamamen silmek m\u00fcmk\u00fcn olmam\u0131\u015ft\u0131r. Yap\u0131lan de\u011fi\u015fiklikler sonras\u0131 1982 Anayasas\u0131n\u0131n \u00fczerinde hala 12 Eyl\u00fcl darbesinin otoriter ve vesayet\u00e7i g\u00f6lgesi bulunmaktad\u0131r. Ayr\u0131ca mevcut Anayasa sistematik b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc, i\u00e7 tutarl\u0131l\u0131\u011f\u0131n\u0131 ve dil-terim uyumunu kaybetmi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>Ne kadar de\u011fi\u015ftirilirse de\u011fi\u015ftirilsin, 1982 Anayasas\u0131 daima 12 Eyl\u00fcl\u2019\u00fcn ac\u0131lar\u0131n\u0131 ve darbenin izlerini hat\u0131rlatacakt\u0131r. Bu bak\u0131mdan, temel felsefesi bireyin \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve korunmas\u0131 olan, yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131 g\u00fc\u00e7lendirmeye y\u00f6nelik kurumsal g\u00fcvenceleri i\u00e7eren yeni bir anayasa yap\u0131lmas\u0131, T\u00fcrkiye\u2019de demokrasi, insan haklar\u0131 ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fcn k\u00f6kle\u015fmesi bak\u0131m\u0131ndan vazge\u00e7ilmez \u00f6neme sahiptir.<\/p>\n\n\n\n<p>T\u00fcrkiye\u2019nin, yarg\u0131lanm\u0131\u015f ve mahkum edilmi\u015f 12 Eyl\u00fcl darbecilerinin haz\u0131rlad\u0131\u011f\u0131 Anayasa ile y\u00f6netilme ay\u0131b\u0131ndan kurtulmas\u0131n\u0131n siyaset kurumunun temel g\u00f6revi oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Hedefimiz En Geni\u015f Kat\u0131l\u0131mla Uzla\u015fmaya Dayal\u0131 Anayasa Yapmak<\/strong><\/h2>\n\n\n\n<p>Bir anayasan\u0131n sivil, demokratik ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc olarak nitelendirilebilmesi i\u00e7in sadece i\u00e7eri\u011finin de\u011fil haz\u0131rlanma y\u00f6nteminin de demokratik ve sivil olmas\u0131 gerekmektedir. Darbeciler taraf\u0131ndan haz\u0131rlanan ve millete dayat\u0131lan 1961 ve 1982 Anayasalar\u0131na kar\u015f\u0131l\u0131k vatanda\u015flar\u0131n kat\u0131l\u0131m\u0131n\u0131n en \u00fcst d\u00fczeyde oldu\u011fu, halk\u0131n temsilcileri taraf\u0131ndan ve en geni\u015f kat\u0131l\u0131m ile m\u00fczakere ve uzla\u015fmaya dayal\u0131 yeni bir anayasan\u0131n haz\u0131rlanmas\u0131 gerekti\u011fine inan\u0131yoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Yeni Anayasan\u0131n Kodlar\u0131<\/strong><\/h2>\n\n\n\n<p><em><strong>\u201cYeni anayasan\u0131n kodlar\u0131: Y\u00fcksek standartl\u0131 demokrasi, g\u00fcvenceli \u00f6zg\u00fcrl\u00fckler ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc\u201d<\/strong><\/em><\/p>\n\n\n\n<p>AK Parti olarak;<\/p>\n\n\n\n<p>Milletin kendi iradesi ve kendi eliyle yapt\u0131\u011f\u0131, her bir vatanda\u015f\u0131m\u0131z\u0131n \u201ci\u00e7inde ben var\u0131m\u201d, \u201cbenim iradem var\u201d dedi\u011fi; \u0131rk, din, mezhep, dil, renk ve k\u00fclt\u00fcr fark\u0131 g\u00f6zetmeden herkesi ku\u015fatan, kucaklay\u0131c\u0131, b\u00fct\u00fcnle\u015ftirici, \u00e7e\u015fitlilikte birli\u011fi savunan;<\/p>\n\n\n\n<p>\u0130nsan onurunu temel alan, devletten \u00f6nce \u00f6zg\u00fcrl\u00fckleri d\u00fczenleyen ve koruyan, b\u00fct\u00fcn kurum ve kurallar\u0131 ile insan\u0131 haklar\u0131yla ya\u015fatmay\u0131 ilke edinen; insan\u0131n maddi ve manevi varl\u0131\u011f\u0131n\u0131 b\u00fct\u00fcn tercihleri ve inan\u00e7lar\u0131yla \u00f6zg\u00fcr bi\u00e7imde ger\u00e7ekle\u015ftirece\u011fi demokratik toplumu in\u015fa eden,<\/p>\n\n\n\n<p>Devleti ve b\u00fct\u00fcn kurumlar\u0131n\u0131 insan\u0131m\u0131za ve milletimize hizmet arac\u0131 olarak g\u00f6ren \u201c\u0130nsan\u0131 Ya\u015fat ki, Devlet Ya\u015fas\u0131n\u201d anlay\u0131\u015f\u0131yla haz\u0131rlanm\u0131\u015f, Devletin milleti ile b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc ve \u00fcniter yap\u0131y\u0131 teminat alt\u0131na alan,<\/p>\n\n\n\n<p>Egemenli\u011fin sahibi milletin demokratik me\u015fru temsilcilerinin \u00f6n\u00fcndeki her t\u00fcrl\u00fc vesayeti ortadan kald\u0131ran; g\u00fc\u00e7ler ayr\u0131l\u0131\u011f\u0131n\u0131 peki\u015ftiren ve bununla birlikte g\u00fc\u00e7lerin e\u015fg\u00fcd\u00fcm\u00fcn\u00fc temin ederek millete hizmeti birinci \u00f6ncelik sayan,<\/p>\n\n\n\n<p>Demokratik kat\u0131l\u0131m\u0131 geni\u015fleten, siyasal kat\u0131l\u0131m\u0131n \u00f6n\u00fcndeki vesayetlere izin vermeyen ve bilgi teknolojileri ile kamusal kat\u0131l\u0131m\u0131 art\u0131ran; \u00e7o\u011fulcu bir toplumsal ve siyasal yap\u0131 kuran, istikrarl\u0131 ve etkili h\u00fck\u00fcmet modelini daha da geli\u015ftiren,<\/p>\n\n\n\n<p>\u00d6zg\u00fcrl\u00fck\u00e7\u00fc ve demokratik Cumhuriyet anlay\u0131\u015f\u0131n\u0131n kazan\u0131mlar\u0131n\u0131 daha da ileriye g\u00f6t\u00fcrmeyi ama\u00e7layan; hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc esas alan, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131 temelinde kurumsal yap\u0131lanmay\u0131 ve i\u015fleyi\u015fi temin eden,<\/p>\n\n\n\n<p>Milletimizin de\u011ferlerini temel alan ve evrensel de\u011fer ve normlar\u0131 g\u00f6zeten, T\u00fcrkiye\u2019yi yeni y\u00fczy\u0131l hedeflerine ula\u015ft\u0131racak etkin ve sa\u011fl\u0131kl\u0131 bir kurumsal yap\u0131lanmay\u0131 tesis eden yeni bir anayasa yapmay\u0131 hedefliyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Yeni Anayasa \u00c7al\u0131\u015fmalar\u0131m\u0131z<\/strong><\/h2>\n\n\n\n<p>AK Parti, sadece \u00e7a\u011fr\u0131da bulunmakla yetinmemi\u015f, somut ad\u0131mlar atm\u0131\u015f ve kendi i\u00e7erisinde yeni anayasa i\u00e7in \u00e7e\u015fitli haz\u0131rl\u0131klar y\u00fcr\u00fctm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>AK Parti Siyasi ve Hukuki \u0130\u015fler Ba\u015fkanl\u0131\u011f\u0131 olarak yeni anayasa \u00e7al\u0131\u015fmalar\u0131na katk\u0131 vermek amac\u0131yla bir dizi \u00e7al\u0131\u015ftaylar yapt\u0131k. Bu \u00e7al\u0131\u015ftaylarda akademisyenleri, uzmanlar\u0131, sivil toplum kurulu\u015flar\u0131n\u0131 ve toplumun de\u011fi\u015fik kesimlerinin temsilcilerini dinleyerek, anayasa konusundaki taleplerini dinledik. \u00c7al\u0131\u015ftaylarda, \u201cT\u00fcrkiye\u2019nin neden yeni anayasaya ihtiyac\u0131 var?\u201d ve \u201cYeni anayasa yapma y\u00f6ntemi ne olmal\u0131?\u201d sorular\u0131na cevap ararken, \u2018Yeni anayasada temel haklar ve \u00f6zg\u00fcrl\u00fckler\u2019 ile \u2018Yeni Anayasa\u2019da Yasama ve Y\u00fcr\u00fctme Organlar\u0131\u2019 ba\u015fl\u0131klar\u0131 gibi bir\u00e7ok konu ba\u015fl\u0131\u011f\u0131n\u0131 da ele ald\u0131k. Bu \u00e7al\u0131\u015ftaylarda ileri s\u00fcr\u00fclen g\u00f6r\u00fc\u015fleri ve elde edilen sonu\u00e7lar\u0131 raporla\u015ft\u0131rd\u0131k ve ba\u015fta Genel Ba\u015fkan\u0131m\u0131z olmak \u00fczere yetkili kurullar\u0131n bilgisine sunduk.<\/p>\n\n\n\n<p>Daha sonra yeni Anayasa \u00e7al\u0131\u015fmalar\u0131n\u0131 y\u00fcr\u00fctmek \u00fczere Cumhurba\u015fkan\u0131m\u0131z Say\u0131n Recep Tayyip Erdo\u011fan taraf\u0131ndan 11 ki\u015filik bir komisyon olu\u015fturuldu. Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131m\u0131z Say\u0131n Cevdet Y\u0131lmaz ba\u015fkanl\u0131\u011f\u0131nda olu\u015fturulan Komisyon olarak \u00e7al\u0131\u015fmalar\u0131m\u0131z\u0131 uzun zamand\u0131r s\u00fcrd\u00fcr\u00fcyoruz.<\/p>\n\n\n\n<p>Bug\u00fcne kadar T\u00fcrkiye&#8217;deki anayasalar, d\u00fcnya anayasalar\u0131, anayasalar\u0131n i\u00e7eriklerinde neler olmas\u0131 gerekti\u011fi, temel hak ve \u00f6zg\u00fcrl\u00fcklerden devletin temel organlar\u0131n\u0131n d\u00fczenleni\u015fine kadar kar\u015f\u0131la\u015ft\u0131rmal\u0131 \u00e7al\u0131\u015fmalar\u0131 ele ald\u0131k.<\/p>\n\n\n\n<p>Buradaki amac\u0131m\u0131z kapal\u0131 kap\u0131lar ard\u0131nda haz\u0131rlanm\u0131\u015f bir anayasa tasla\u011f\u0131 ile toplumun kar\u015f\u0131s\u0131na \u00e7\u0131kmak yerine \u00f6nce toplumsal talepler do\u011frultusunda partimizin fikri haz\u0131rl\u0131\u011f\u0131n\u0131 olu\u015fturmakt\u0131r. Partilerin kendi anayasa taslaklar\u0131 ile masaya oturmalar\u0131n\u0131n uzla\u015fmay\u0131 g\u00fc\u00e7le\u015ftirece\u011fini, beyaz bir sayfa a\u00e7arak uzla\u015fma ile bir metin yaz\u0131lmas\u0131 gerekti\u011fini d\u00fc\u015f\u00fcn\u00fcyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>T\u00fcrkiye Y\u00fczy\u0131l\u0131\u2019n\u0131 Yeni, Sivil Ve \u00d6zg\u00fcrl\u00fck\u00e7\u00fc Bir Anayasa \u0130le <\/strong><strong>Ta\u00e7land\u0131ral\u0131m<\/strong><\/h2>\n\n\n\n<p>\u00d6zetlemek gerekirse, bizim anayasa yapma y\u00f6ntemimiz halkta ba\u015flayacak ve en son yine halkta bitecek bir yol izleyecektir. \u00d6nce toplumun taleplerini toplayarak partilerin uzla\u015fmas\u0131yla bir taslak haz\u0131rlanmas\u0131, daha sonra bu tasla\u011f\u0131n TBMM\u2019de bulunan b\u00fct\u00fcn partilerin kat\u0131l\u0131m\u0131yla bir metin haline gelmesi ve referandumla halk\u0131m\u0131z\u0131n onay\u0131na sunulmas\u0131 gerekti\u011fine inan\u0131yoruz.<\/p>\n\n\n\n<p>Yeni anayasan\u0131n kutupla\u015ft\u0131r\u0131c\u0131 de\u011fil uzla\u015ft\u0131r\u0131c\u0131, ayr\u0131\u015ft\u0131r\u0131c\u0131 de\u011fil birle\u015ftirici, yasak\u00e7\u0131 de\u011fil \u00f6zg\u00fcrl\u00fck\u00e7\u00fc olmas\u0131, farkl\u0131l\u0131klarda de\u011fil ortak noktalarda bulu\u015fturmas\u0131 temel ilkemiz, anayasa haz\u0131rl\u0131k s\u00fcrecinin sa\u011fl\u0131kl\u0131 i\u015fleyebilmesi temel \u00f6nceli\u011fimizdir.<\/p>\n\n\n\n<p>Bu noktada devletimizle milletimizi bulu\u015fturacak yeni Anayasa\u2019n\u0131n yap\u0131m s\u00fcrecinin s\u0131\u011f tart\u0131\u015fmalara heba edilmesini, kutupla\u015ft\u0131r\u0131c\u0131 bir dile hapsedilmesini kesinlikle tasvip etmedi\u011fimizin de alt\u0131n\u0131 \u00e7izmek istiyorum.<\/p>\n\n\n\n<p>AK Parti olarak T\u00fcrkiye Y\u00fczy\u0131l\u0131\u2019n\u0131 yeni, sivil ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc bir Anayasa ile ta\u00e7land\u0131rma konusundaki kararl\u0131l\u0131\u011f\u0131m\u0131z ortadad\u0131r. T\u00fcm siyasi partilere d\u00fc\u015fen g\u00f6rev en ideal anayasa metni ortaya koymak i\u00e7in oturup konu\u015fmak, m\u00fczakere etmek ve uzla\u015fmayla bu s\u00fcreci nihayete erdirmektir. Gelecek nesillere b\u0131rakaca\u011f\u0131m\u0131z en \u00f6nemli miraslardan birisi sivil bir Anayasa olacakt\u0131r.
