Yine, mevcut Anayasan\u0131n ekonomik ve toplumsal geli\u015fmelerin gerisinde kalmas\u0131 ve me\u015fruiyetinin tart\u0131\u015fmal\u0131 olmas\u0131, yeni bir anayasa yap\u0131lmas\u0131n\u0131 zorunlu bir ihtiya\u00e7 haline getirmi\u015ftir.<\/p>\n\n\n\n<p>Yeni bir anayasa ayn\u0131 zamanda sorunlar\u0131n uzla\u015f\u0131yla \u00e7\u00f6z\u00fcm\u00fcne hizmet edebilir. \u00d6rne\u011fin, Ter\u00f6rs\u00fcz T\u00fcrkiye g\u00fcndemi kapsam\u0131nda sorunlar\u0131n \u00e7\u00f6z\u00fclmesi, Alevilerin taleplerinin kar\u015f\u0131lanmas\u0131 ile inan\u00e7 ve k\u00fclt\u00fcrel konular, anayasal d\u00fczeyde d\u00fczenleme gerektirebilir. Sivil, demokratik, yeni nesil haklar\u0131 da kapsayan, temel hak ve \u00f6zg\u00fcrl\u00fckleri g\u00fcvence alt\u0131na alan, toplumsal dengeleri g\u00f6zeten, \u00e7evreci, \u00f6zg\u00fcrl\u00fck\u00e7\u00fc ve kat\u0131l\u0131mc\u0131 bir anayasan\u0131n yap\u0131lmas\u0131 y\u00f6n\u00fcnde toplumda beklenti ve anlay\u0131\u015f birli\u011fi olu\u015fmu\u015ftur. 1982 Anayasas\u0131 ile ilgili tart\u0131\u015fmalar\u0131n ve beklentilerin \u0131\u015f\u0131\u011f\u0131nda bug\u00fcne de\u011fin siyasi partiler ve sivil toplum kurulu\u015flar\u0131 taraf\u0131ndan muhtelif anayasa taslaklar\u0131 haz\u0131rlanm\u0131\u015ft\u0131r. Yeni anayasa ihtiyac\u0131 bilim \u00e7evreleri, \u00fcniversiteler, meslek gruplar\u0131 taraf\u0131ndan da tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Gelinen a\u015famada, yeni anayasa bir ihtiya\u00e7 olarak \u00f6ncelikli ele al\u0131nmay\u0131 beklemektedir.<\/p>\n\n\n\n<p>Bu makalede; dengeleri g\u00f6zeten,&nbsp; \u00e7o\u011fulcu, kat\u0131l\u0131mc\u0131, \u00f6zg\u00fcrl\u00fck\u00e7\u00fc ve me\u015fru sivil bir anayasan\u0131n ilkeler baz\u0131nda haz\u0131rlanma y\u00f6ntemi ve i\u00e7eri\u011fi \u00fczerinde durulmu\u015ftur. Hi\u00e7 ku\u015fkusuz yeni anayasa sadece i\u00e7eri\u011fiyle de\u011fil, ayn\u0131 zamanda haz\u0131rlanma y\u00f6ntemi ile de tan\u0131mlanmal\u0131d\u0131r. Bu nedenle, yeni bir anayasa talebi, hem haz\u0131rlanma y\u00f6ntemine hem de i\u00e7eri\u011fe y\u00f6neliktir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Yeni Anayasa Nas\u0131l Bir Y\u00f6ntemle Haz\u0131rlanmal\u0131d\u0131r?<\/strong><\/h2>\n\n\n\n<p>M\u00fclga 1961 ve mevcut 1982 anayasalar\u0131 darbeyi yapan askerlerin belirledi\u011fi kurucu meclisler taraf\u0131ndan, kendi \u00f6ncelikleri do\u011frultusunda haz\u0131rlanm\u0131\u015ft\u0131r. Her iki anayasa da y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi g\u00fcnden itibaren tart\u0131\u015fmalara konu olmu\u015f ve \u00e7ok say\u0131da de\u011fi\u015fikli\u011fe u\u011fram\u0131\u015ft\u0131r. Anayasa, halk\u0131 temsil eden sivil toplum kurulu\u015flar\u0131 ve siyasi partilerin, \u00fcniversitelerin, baro ve di\u011fer meslek kurulu\u015flar\u0131n\u0131n, toplumun \u00f6rg\u00fctl\u00fc kesimlerinin en geni\u015f \u015fekilde s\u00fcrece dahil edilerek g\u00f6r\u00fc\u015f ve \u00f6nerileri al\u0131nmas\u0131 suretiyle meclis taraf\u0131ndan haz\u0131rlanmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Haz\u0131rlanan anayasa metni k\u0131sa, sade, a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olmal\u0131d\u0131r. Yoruma a\u00e7\u0131k, s\u00fcsl\u00fc ve abart\u0131l\u0131 kelime ve ifadelerden ka\u00e7\u0131n\u0131lmal\u0131d\u0131r. Anlam ve alg\u0131lama karma\u015fas\u0131na neden olmayacak bir teknikle yaz\u0131lmal\u0131d\u0131r.&nbsp; Mecliste temsil edilen siyasi gruplar\u0131n kat\u0131l\u0131m\u0131yla haz\u0131rlanan anayasa metninin kabul edilmesi ve en geni\u015f kat\u0131l\u0131m sa\u011flanarak halkoyuna sunulmas\u0131, demokratik me\u015fruiyeti g\u00fc\u00e7lendirecektir.<\/p>\n\n\n\n<p>Mevcut meclisimiz,&nbsp; y\u00fcksek bir temsil g\u00fcc\u00fcne sahiptir.&nbsp; Bu kadar geni\u015f temsil kabiliyetine sahip olan meclisimiz yeni anayasan\u0131n haz\u0131rlanmas\u0131nda ve halkoyuna sunulmas\u0131nda me\u015fruiyete ve yetkiye sahiptir. Komisyona kat\u0131lan partilerin \u00fczerinde mutab\u0131k kald\u0131klar\u0131 59 madde yeni \u00e7al\u0131\u015fma s\u00fcrecine bir ba\u015flang\u0131\u00e7 olabilir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Yeni Anayasa Hangi \u0130\u00e7erikle Haz\u0131rlanmal\u0131d\u0131r?<\/strong><\/h2>\n\n\n\n<p>Hem b\u00fct\u00fcnl\u00fck hem de sivil iradenin yans\u0131mas\u0131 bak\u0131m\u0131ndan s\u0131f\u0131rdan yeni bir anayasa haz\u0131rlanmal\u0131d\u0131r. Bu yolla halk\u0131n iradesi ile yeni bir anayasa yap\u0131lm\u0131\u015f olacakt\u0131r. Yeni anayasan\u0131n t\u00fcm h\u00fck\u00fcmlerinde uzla\u015f\u0131 sa\u011flan\u0131lmal\u0131d\u0131r. Hi\u00e7 ku\u015fkusuz, \u00f6nceki anayasada yer alan h\u00fck\u00fcmlerin bir k\u0131sm\u0131 de uzla\u015f\u0131 ile yeni anayasada aynen veya k\u0131smen d\u00fczenlenmi\u015f haliyle yer alabilir.<\/p>\n\n\n\n<p>Yeni anayasada ba\u015flang\u0131\u00e7 h\u00fck\u00fcmlerine yer verilmeyebilir. Demokrasisi geli\u015fmi\u015f bir\u00e7ok \u00fclkenin anayasalar\u0131nda ba\u015flang\u0131\u00e7 h\u00fck\u00fcmleri yer almamaktad\u0131r. \u00c7o\u011fulcu demokrasi, insan haklar\u0131, insan onuru, ho\u015fg\u00f6r\u00fc, toplumsal bar\u0131\u015f, hukuk devleti, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ve benzeri evrensel de\u011ferleri referans alan bir giri\u015f metni olabilir.<\/p>\n\n\n\n<p>Yeni anayasa, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc esas almal\u0131d\u0131r. Devletin temeli, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcne dayanmal\u0131d\u0131r. Hukuk devleti sadece kural koyan devlet de\u011fil, ayn\u0131 zamanda koydu\u011fu kurallara uyan devlettir. Hukuk devletinde, toplum ad\u0131na yetki kullanan t\u00fcm makamlar\u0131n, \u00f6zelikle yarg\u0131 kurumlar\u0131n\u0131n g\u00f6rev ve yetkileri belirgin olmal\u0131d\u0131r. Devletin sosyal, laik, demokratik niteli\u011fi korunmal\u0131, zaman\u0131n ko\u015fullar\u0131na uygun olarak geli\u015fen i\u015fleve kovu\u015fturulmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Yeni anayasa, se\u00e7ilmi\u015f organlar \u00fczerinde vesayet organlar\u0131na yer vermeyen, \u00e7o\u011fulcu ve kat\u0131l\u0131mc\u0131 bir siyasal rejimi esas alan, her t\u00fcrl\u00fc vesayet\u00e7ilikten uzak, siville\u015fmeyi \u00f6nceleyen,&nbsp; devlet ve birey ili\u015fkilerini \u00f6zg\u00fcrl\u00fck ekseninde d\u00fczenleyen bir anayasa olmal\u0131d\u0131r. Bu ba\u011flamda, Milli G\u00fcvenlik Kurulu bir dan\u0131\u015fma kurulu olarak yeniden yap\u0131land\u0131r\u0131lmal\u0131,&nbsp;&nbsp; g\u00f6rev alan\u0131 savunma konular\u0131yla s\u0131n\u0131rl\u0131 olacak \u015fekilde yasa ile d\u00fczenlenmelidir. Y\u00d6K ve Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131, zaman\u0131n gereklerine ve toplumsal ihtiya\u00e7lara g\u00f6re yeniden yap\u0131land\u0131r\u0131lmal\u0131d\u0131r.&nbsp;<\/p>\n\n\n\n<p>Yeni anayasa, \u015fiddet i\u00e7ermeyen t\u00fcm fikirlerin beyan edilmesine,&nbsp; \u00f6rg\u00fctlenmesine, kurduklar\u0131 partiler vas\u0131tas\u0131yla iktidar i\u00e7in yar\u0131\u015fmalar\u0131na en geni\u015f anlamda izin veren d\u00fczenlemeler i\u00e7ermelidir.<\/p>\n\n\n\n<p>Yeni anayasa yerel ve merkezi idarenin her kademesindeki y\u00f6netim biriminde karar organlar\u0131n\u0131n se\u00e7imle olu\u015fmas\u0131na, siyasi alan\u0131n geni\u015fletilmesine, kamu g\u00f6revlileri dahil her kesin \u00f6zg\u00fcrce siyaset yapmas\u0131na, demokrasinin vazge\u00e7ilmez unsurlar\u0131 olan siyasi partilerin i\u00e7 yap\u0131lar\u0131n\u0131n demokratikle\u015fmesine ve karar alma s\u00fcre\u00e7lerine \u00fcyelerin kat\u0131lmas\u0131na y\u00f6nelik d\u00fczenlemeler i\u00e7ermelidir.&nbsp;<\/p>\n\n\n\n<p>Yeni anayasa, &nbsp;yeni nesil haklar\u0131 da kapsayan ki\u015fi hak ve \u00f6zg\u00fcrl\u00fcklerini siyasi iktidara kar\u015f\u0131 koruyan mekanizmalar\u0131 g\u00fc\u00e7lendiren, hak ve \u00f6zg\u00fcrl\u00fcklerin geni\u015f anlamda kullan\u0131ld\u0131\u011f\u0131, her bir hak ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn niteli\u011fine \u00f6zg\u00fc olarak getirilen istisnai k\u0131s\u0131tlamalar\u0131n en aza indirildi\u011fi, ki\u015fiyi devlet otoritesine kar\u015f\u0131 koruyan, t\u00fcm hak ve \u00f6zg\u00fcrl\u00fcklerden ayr\u0131m g\u00f6zetilmeksizin herkesin e\u015fit yararlanaca\u011f\u0131 d\u00fczenlemeler i\u00e7ermelidir. D\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma \u00f6zg\u00fcrl\u00fc\u011f\u00fcne hi\u00e7bir k\u0131s\u0131tlama getirilmemelidir.&nbsp;<\/p>\n\n\n\n<p>Yeni anayasada inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fc tam olarak g\u00fcvenceye al\u0131nmal\u0131d\u0131r. Bireylerin; devlet ve di\u011fer yap\u0131 ve gruplar\u0131n bask\u0131s\u0131na maruz kalmadan her hangi bir dine inanma, o dinin gerektirdi\u011fi ibadeti yapma, dini \u00f6\u011frenme ve \u00f6\u011fretme, dinine g\u00f6re \u00f6zel ya\u015famlar\u0131n\u0131 d\u00fczenleme \u00f6zg\u00fcrl\u00fcklerine s\u0131n\u0131rlama getirilmemelidir. Devlet en geni\u015f anlamda inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Ancak, devletin dini hizmet sunup sunmayaca\u011f\u0131 konusu tart\u0131\u015fmal\u0131d\u0131r. Devletin dini hizmetler sunmay\u0131p, bu hizmetlerin o dine sahip olanlarca yerine getirilmesi bir tercihtir. Vatanda\u015fl\u0131k, anadilde e\u011fitim ve \u00f6\u011fretim hakk\u0131 yasa ile d\u00fczenlenmelidir.<\/p>\n\n\n\n<p>Yeni anayasada, halk\u0131n iradesine dayanan demokrasiyle ba\u011fda\u015fmad\u0131\u011f\u0131 ve gelecek nesillerin kendi kaderleri hakk\u0131nda s\u00f6z s\u00f6ylemeyi engelledi\u011fi i\u00e7in prensip olarak yasak\u00e7\u0131 h\u00fck\u00fcmlere yer verilmemesi tercih edilmelidir.<\/p>\n\n\n\n<p>Yeni anayasada, yarg\u0131n\u0131n tarafs\u0131z ve ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, hakim g\u00fcvencesi net vurgulanmal\u0131, bunlar\u0131n fiilen uygulanmas\u0131 i\u00e7in gerekli olan kurallar ve ilkeler yer almal\u0131d\u0131r. HSK, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, yarg\u0131n\u0131n tarafs\u0131zl\u0131\u011f\u0131 ve h\u00e2kim g\u00fcvencesi ilkeleri ile uyumlu olarak yeniden d\u00fczenlenmelidir.<\/p>\n\n\n\n<p>Yeni anayasada, ba\u015fkanl\u0131k sistemi yer almal\u0131d\u0131r. Ba\u015fkanl\u0131k sistemi, \u00fclkemizin \u00e7o\u011fulcu yap\u0131s\u0131na denk d\u00fc\u015fmektedir.
